The Schaber Downtown Courthouse hears misdemeanor and felony cases including Sacramento DUI cases from the arraignment stage through the jury trial. The courthouse is home to 47 departments located throughout six floors.
A criminal case begins with the suspected violation of a law. An arresting agency will issue a citation for the suspected violation and recommend it for filing by the Sacramento District Attorney. If the District Attorney feels that a case is warranted, he or she will file the case and institute criminal charges against the defendant. On the citation a mandatory arraignment date will be listed. A person cited for a charge must appear in court on the date listed on the citation.
Failure to appear for an arraignment can and likely will result in a warrant being issued for the defendant’s arrest. A defendant can hire a Sacramento Criminal Defense Attorney to appear on his or her behalf at all court appearances in most cases. If the case is a felony, the defendant will have to appear at all court dates, but should consult a Sacramento Criminal Defense Attorney immediately after being arrested.
A misdemeanor case out of Sacramento can carry with it serious consequences, including up to a year in county jail. A felony case can result in a state prison sentence and a number of other harsh penalties.
