SACRAMENTO DUI FAQ's

What does the term DUI stand for?Sacramento DUI FAQ Drunk Driving Defense

The term DUI stands for Driving Under the Influence – this refers to any individual who is under the influence of alcohol and/or drugs at the time that he or she is driving. It is a crime to drive while under the influence of alcohol or drugs in the state of California. Depending upon the unique circumstances surrounding the situation, DUI in Sacramento can be a misdemeanor or felony offense.

In Sacramento, what is considered the legal limit of intoxication?

In Sacramento, as in the entire state of California, the legal limit of intoxication is a blood alcohol concentration (BAC) of .08% or less. What this means is, for every 10,000 drops of blood measured, there are 8 drops of pure alcohol in your bloodstream. These are very small amounts of alcohol, which must be measured precisely. If your BAC is over the .08% limit, you are considered to be intoxicated for the purposes of a DUI charge in Sacramento. Additionally, anyone under the age of 21 can be arrested for DUI with a BAC that is as little as .01%.

Am I required to submit to a blood or breath test if I am pulled over for a suspected DUI in Sacramento County?

People often mistakenly assume that they have the right to refuse a blood and/or breath test with no penalties involved. This is not the case. While you can refuse to take either test, the penalty for this decision is the automatic suspension of your driver’s license for one full year. This suspension cannot be appealed, and you will not be allowed to drive for any reason, nor issued any restricted permit for the duration. You are, however, allowed to refuse common field sobriety tests, if you so choose.

I’ve heard that some DUI cases are considered ‘wobblers’. What does that mean?

A gross misdemeanor may sometimes be called a ‘wobbler’ in the Sacramento DUI court systems. This means that the case can be tried either as a misdemeanor, or as a felony, depending upon the unique circumstances surrounding the case. A competent Sacramento DUI attorney can often make sure that any wobbler charge is tried as a misdemeanor rather than as a felony, so it’s important to obtain legal counsel early in the process if you think your case may fall under this area.

Will I have to appear in front of a judge for my Sacramento DUI charge?

Not always. In most instances, if you have retained an experienced Sacramento DUI attorney, he or she will appear in court on your behalf. Your Sacramento DUI lawyer will be able to enter your plea in front of the judge on your behalf thereby saving you valuable time and minimizing the stress involved. If you have qualified legal counsel, you can rest assured that your Sacramento DUI case will be handled professionally from start to finish, while you focus on taking care of your daily obligations.

How long do I have to contest my license suspension if I’m charged with DUI in Sacramento?

You have ten days starting from the date of your arrest to file for a DMV hearing regarding your license. If you do not file for a hearing within that time frame, your license will be suspended after the temporary permit expires. This means that it is possible to lose your license on a first time DUI charge in Sacramento, regardless of the circumstances.  Because the procedures in a DMV hearing can be complex and confusing, the chances of losing your license increases unless you have qualified legal counsel that is experienced with Sacramento DUI laws.

What should I look for when hiring a Sacramento DUI attorney for my DUI charge?

What you want when choosing a Sacramento DUI lawyer is someone who is well-versed in DUI law, and who has practical experience in applying these laws to real life cases. The Sacramento DUI lawyer you choose should be familiar with the laws in his or her area, and should have a plan to keep abreast of the latest information in the field of DUI.
